GENERAL TERMS OF ACCESS TO PAID OR RESTRICTED RESOURCES

Mandatory Registration on the Service, payment for the Service, and carrying out specific actions and requirements provided for by the Service are all considered prerequisites for the User to obtain access to any paid and/or restricted resources of the Service.

Obligations of Metoshi to provide paid and/or restricted resources of the Service to the User are counter to the User’s own obligations to pay for or perform actions specified by the Service as stipulated in the present User Agreement and/or the terms of a separate license agreement and/or other agreement/transaction concluded in the form of an offer or otherwise legally between the Parties. In the event that the User fails to comply with these obligations, Metoshi may suspend the User’s access to such resources in whole or in part.

Metoshi provides the User with access to paid and/or restricted resources of the Service as long as there is a possibility to do so, which is determined, among other things, by the User’s compliance with the rights and obligations established by the present User Agreement and/or other agreement outlining rights and obligations. Due to the need to comply with the rights and obligations set forth in the agreements between the Parties, wherein normal functioning of the Services is impossible without said compliance, the User hereby recognizes that their failure to comply with their obligations may lead to Metoshi being unable to fulfill its own obligations with regard to providing access to the aforementioned resources.

Due to the nature of the paid and/or restricted resources of the Service offered by Metoshi and aimed at meeting the individual needs of the User, Metoshi shall not be obliged to provide access to such resources to all parties requesting it, and may refuse to provide access to the User if such provision fails to comply with the requirements outlined in the present User Agreement and/or the terms of a separate license agreement and/or other agreement/transaction concluded in the form of an offer or otherwise legally between the Parties.

The terms for providing specific paid and/or restricted resources of the Service, including their content, volume, availability periods and pricing, payment procedures, rights and obligations of the Parties, shall be determined both by the terms of the present User Agreement and/or the terms of a separate license agreement and/or other agreement/transaction concluded in the form of an offer or otherwise legally between the Parties, and any other conditions, rules and requirements posted on/set forth in the interface of the relevant Service.

All paid and/or restricted resources provided by the Service are subject to change, amendment, and updates, and therefore they are offered for use on the “as is” basis, that is, in the form and to the extent that they are provided by Metoshi at the moment the User accesses the Services.

Metoshi has the right to use the contact details specified in the User’s Personal Profile to send the User notifications via e-mail related to the execution of concluded transactions, including notifications about the statuses of any paid and/or restricted resources being provided, as well as renewal methods and other informational messages.

When using paid and/or restricted resources of the Service, the User undertakes to comply with the requirements set forth in the provisions of the User Agreement and/or other agreement, the relevant terms of their selected Service(s), and any instructions provided in the interface of the Service.

At the request of Metoshi, the User is obliged to provide any information or documents necessary to identify the User as a party to the agreement in the event that the User sends claims, requests or other queries to Metoshi related to the provision of paid and/or restricted resources of the Service. Furthermore, Metoshi has the right to verify the identity of the User as a party to the Agreement on its own by verifying the information specified by the User in their Personal Profile on the Service, and compare their details with payment details under the Agreement.

Any actions performed by the User on the Services following their Authorization, including through the use of their Credentials, shall be recognized by the Parties as actions committed by the User themselves and possessing the legal force of a simple electronic signature.

The access costs or conditions applicable to any paid and/or restricted resources of the Service chosen by the User when concluding the present Agreement shall be determined based on their parameters (type, package contents and other characteristics), and shall be reported to the User in established units through the user interface on the Service when an order or application is made, unless otherwise provided for by the terms of the relevant Service.

The procedure and method of payment or other transaction performed by the User to gain access to paid and/or restricted resources of the Service provided by Metoshi shall be determined depending on the specific Service(s) chosen by the User in the manner established by such Service and/or the terms of a separate license agreement and/or other agreement/transaction concluded in the form of an offer or otherwise legally between the Parties, including: non-cash transfer of funds to Metoshi from payment cards, payment to the current account against the issued billing documents (invoices), payment through a payment service and/or a bank chosen by the User, and/ or a Metoshi partner bank; payment involving another legal entity (agent); other transaction methods.

Metoshi has the right to instruct/authorize its Affiliates or other legal entities based on agreements concluded with them to accept payments for any paid and/or restricted resources of the Service, whereby the payments made by the Users to such companies shall constitute proper fulfillment of their obligations to Metoshi.

All payments or other transactions shall be carried out using the established payment methods.

The fact of providing the User with access to specific paid and/or restricted resources and their respective extents shall be determined based on the statistical data accumulated by the Metoshi accounting system.

It is agreed by the present Parties that in relation to any monetary obligations of Metoshi to Users arising in connection with the receipt of funds or other means for the use of paid and/or restricted resources of the Service, no legal interest (interest on the amount of debt for the period of use of funds) is charged.
